NXT Museum B.V. | Version 2026

1. Definitions and interpretation

1.1 In these Visitor Terms, the following capitalised terms have the following meanings:

ADE: the Amsterdam Dance Event.

Event: any evening, night, day or dance event held at the Venue, including any event held as part of ADE, irrespective of whether it is organised by a Promoter or by Nxt Museum.

House Rules: the rules of conduct set out in Articles 4 to 9 of these Visitor Terms, together with any additional rules, signs and instructions displayed at the Venue or communicated by Venue Staff.

Nxt Museum: NXT Museum B.V., a private limited company having its registered office in Amsterdam, with its business address at Asterweg 22A, 1031 HP Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce under number 99273071, operating the Venue under the trade name Nxt Museum.

Production Partner: any company engaged by or together with Nxt Museum to carry out the production and operational management of an Event at the Venue, including crowd management, security, access control and bar operations.

Promoter: the party that organises the programme of an Event and is identified as such on the Ticket, the ticket shop or the event page. Where no third party is identified as promoter, Nxt Museum acts as Promoter.

Promoter Terms: the terms and conditions, house rules and privacy statement of the Promoter or the Ticket Seller that apply to the purchase of a Ticket and to the programme of an Event.

Ticket: any valid proof of entitlement to access an Event, including an electronic ticket, barcode, QR code, wristband, guest list registration, accreditation or pass.

Ticket Seller: the party that sells a Ticket to the Visitor as contracting party (merchant of record), as identified to the Visitor at the time of purchase. This may be the Promoter, Nxt Museum or another party.

Venue: the premises of Nxt Museum, including the exhibition halls, Nxt Stage, Nxt Lab, the restaurant and bar areas, backstage areas, locker areas, smoking areas, entrance and queuing areas, and all outdoor areas within the fenced perimeter, as well as the premises of restaurant Metro to the extent used for an Event, all at Asterweg 22, 1031 HP Amsterdam.

Venue Staff: all persons acting on behalf of Nxt Museum or a Production Partner at the Venue, including employees, security officers, stewards, first aid personnel, bar staff, ticket scanners and other contractors, who are identifiable as such by clothing, wristband, badge or otherwise.

Visitor: any natural person present at the Venue in connection with an Event, including Ticket holders, guest list guests, friends and family, ADE delegates, press and backstage guests, but excluding persons present solely in the course of performing work for the Event.

Visitor Terms: these Visitor Terms & Conditions and House Rules Events.

1.2 Headings are for convenience only. The words “including” and “such as” are illustrative and do not limit the preceding words. References to Articles are to articles of these Visitor Terms.

2. Scope and allocation of responsibilities

2.1 These Visitor Terms apply to every Event and to every Visitor from the moment the Visitor enters the queuing or entrance area of the Venue until the Visitor has left the Venue. By purchasing or accepting a Ticket for an Event, or by entering the Venue, the Visitor accepts these Visitor Terms.

2.2 Where an Event is organised by a Promoter, the Promoter is responsible for the programme and the Ticket Seller is responsible for the sale of Tickets. Accordingly, the Promoter or the Ticket Seller, as applicable, and not Nxt Museum, is responsible for:

(a) the sale, pricing, delivery and transfer of Tickets, including service fees;

(b) refunds, exchanges, cancellations and postponements relating to Tickets;

(c) the programme, the line-up, the artists and the content, quality and duration of their performances;

(d) information about the Event, marketing and promotion; and

(e) customer support relating to any of the above.

2.3 As operator of the Venue, Nxt Museum is responsible for, and retains full control over:

(a) access to the Venue, door policy and access control;

(b) safety, security and crowd management;

(c) capacity management and the use and layout of the areas within the Venue;

(d) the House Rules and their enforcement;

(e) the bar and food and beverage service, lockers and other Venue facilities; and

(f) emergency measures, including the interruption, suspension or termination of an Event.

2.4 Nxt Museum may exercise its rights under these Visitor Terms through a Production Partner and through Venue Staff. Any instruction given by Venue Staff is deemed to be an instruction of Nxt Museum.

2.5 The Promoter Terms apply to the purchase of a Ticket and to the programme of an Event. These Visitor Terms apply to access to and presence at the Venue. In the event of any conflict between the Promoter Terms and these Visitor Terms on matters of access, safety, security, crowd management, capacity, conduct at the Venue, prohibited items or Venue facilities, these Visitor Terms prevail.

2.6 Where Nxt Museum itself organises an Event or acts as Ticket Seller, the provisions of these Visitor Terms relating to the Promoter or the Ticket Seller apply to Nxt Museum in that capacity, and Article 3.6 applies. Where the Production Partner acts as Ticket Seller, Article 3.6 applies to the Production Partner accordingly.

2.7 Deviations from these Visitor Terms are only valid if expressly agreed in writing by Nxt Museum. General terms and conditions of a Visitor do not apply.

3. Tickets

3.1 The agreement for the purchase of a Ticket is concluded between the Visitor and the Ticket Seller. Nxt Museum is not a party to that agreement unless Nxt Museum is expressly identified as Ticket Seller at the time of purchase.

3.2 Tickets must be obtained exclusively from the Ticket Seller or through a resale platform officially designated by the Promoter. Nxt Museum may refuse access to any person holding a Ticket that was obtained through any other channel, that has been copied, altered or tampered with, or that is otherwise invalid.

3.3 A Ticket entitles one person to enter the Event once. The ticketing and scanning records of the Ticket Seller are conclusive as to the validity and use of a Ticket. Where a Ticket has been scanned previously, access may be refused.

3.4 The Visitor bears the risk of loss, theft, damage and misuse of a Ticket from the moment it is made available to the Visitor. Nxt Museum is not liable for any such loss, theft, damage or misuse.

3.5 Any request for a refund, exchange or compensation relating to a Ticket must be directed to the Ticket Seller and is governed by the Promoter Terms. Refusal of access or removal from the Venue in accordance with these Visitor Terms does not entitle the Visitor to any refund or compensation from Nxt Museum. The refund of a Ticket in the event of refusal of access is governed by Articles 4.11 to 4.13.

3.6 Where Nxt Museum or the Production Partner acts as Ticket Seller:

(a) a Ticket cannot be exchanged or returned once purchased. As a Ticket relates to a leisure service on a specific date, the statutory right of withdrawal does not apply, in accordance with Article 6:230p of the Dutch Civil Code;

(b) if the Event is cancelled in its entirety, the Ticket Seller will refund the face value of the Ticket to the original purchaser;

(c) if the Event is postponed, the Ticket remains valid for the new date. A Visitor who is unable or unwilling to attend on the new date may request a refund of the face value of the Ticket within the period communicated by the Ticket Seller; and

(d) service fees and administration costs are not refunded, save where mandatory law provides otherwise.

4. Conditions of entry

4.1 Access to Events is restricted to persons aged 18 and over, unless Nxt Museum has expressly stated otherwise for a specific Event. Every Visitor must carry a valid original identity document (passport, identity card, driving licence or residence document) and must show it at the request of Venue Staff, both on entry and during the Event. Access will be refused to any person who is unable to prove that they are 18 or over.

4.2 All Visitors are searched on entry. By entering the Venue, the Visitor consents to security checks, which may include a pat-down of clothing, a search of bags and other items carried, a request to empty pockets and show their contents, and passing through a detection gate. Pat-downs are carried out by a security officer of the same sex wherever practicable, and always at the Visitor’s request. Security checks may also be carried out during the Event. A person who does not cooperate with a security check will be refused access or, during the Event, removed from the Venue.

4.3 Nxt Museum operates a door policy and reserves the right, at all times, to refuse access to any person, including a person holding a valid Ticket. Access may in particular be refused to any person who, in the reasonable opinion of Venue Staff:

(a) does not hold a valid Ticket or valid identification;

(b) is visibly intoxicated or under the influence of alcohol, drugs or other substances;

(c) carries prohibited items;

(d) has been excluded from the Venue under Article 7;

(e) behaves or has behaved in a threatening, aggressive, disrespectful, discriminatory or otherwise inappropriate manner, including towards Venue Staff;

(f) seeks to enter as part of a large group;

(g) wears formal attire (such as a suit or dress shirt), a football shirt, motorcycle club clothing or other clothing with group-specific texts or symbols, or clothing, symbols, texts or images that are offensive, discriminatory or otherwise inappropriate for the nature of the Event;

(h) shows no evident familiarity with or interest in the programme or the nature of the Event; or

(i) presents a risk to the safety, order or security of the Venue, the Event, other Visitors or Venue Staff.

4.4 The door policy is applied without discrimination on the basis of race, religion, belief, sex, sexual orientation, gender identity, disability or any other ground prohibited by law. A person who has been refused access may contact Nxt Museum in accordance with Article 15.2.

4.5 Any wristband or accreditation issued must be worn visibly throughout the Event and must not be removed, transferred or tampered with. An accreditation or backstage pass grants access only to the areas specified and does not entitle the holder to any separate facilities.

4.6 There is no re-entry. A Visitor who leaves the Venue, including the fenced outdoor area, is not entitled to re-enter the Event, unless Venue Staff expressly permit re-entry in a specific case.

4.7 The opening time, last entry time and closing time announced for an Event are binding. Unless a different last entry time has been announced for the Event, the entrance closes two hours before the announced closing time, after which no further access is granted, including to Ticket holders. Nxt Museum may adjust the opening, last entry or closing time where required by permit conditions, safety or operational circumstances.

4.8 The maximum capacity of the Venue and of each area within it is determined by Nxt Museum in accordance with applicable permits and safety requirements. Nxt Museum may at any time close or restrict access to an area, apply a one-in-one-out policy or otherwise regulate the flow of Visitors. A Ticket does not guarantee access to every area of the Venue at every moment.

4.9 Holders of a Ticket purchased in advance and Visitors on the guest list have priority of entry over persons queuing to buy a Ticket at the door. Tickets at the door are sold only if available and only for as long as capacity permits.

4.10 A guest list registration is personal and non-transferable, is valid only for the Event and up to the time communicated for that Event, and grants access only on presentation of a valid identity document in the name of the registered person. A guest list registration does not guarantee access where the Venue has reached capacity. Articles 4.1 to 4.8 apply in full to guest list guests.

4.11 A Visitor who is refused access under Article 4.3 before the Ticket has been scanned will receive a refund of the face value of the Ticket from the Ticket Seller, upon request of the original purchaser, unless access was refused because the Visitor failed to comply with these Visitor Terms, including the House Rules, or for any other reason attributable to the Visitor, including where the Visitor:

(a) was unable to show a valid identity document or is under 18 years of age;

(b) was visibly intoxicated or under the influence of alcohol, drugs or other substances;

(c) carried drugs or other prohibited items, or refused to cooperate with a security check;

(d) had been excluded from the Venue under Article 7.3;

(e) behaved in a threatening, aggressive, disrespectful or discriminatory manner, including towards Venue Staff; or

(f) arrived after the last entry time referred to in Article 4.7.

4.12 Service fees and administration costs are not refunded under Article 4.11. A refund under Article 4.11 applies only to a Ticket purchased directly from the Ticket Seller. A Visitor who acquired a Ticket through a resale platform such as TicketSwap is not entitled to a refund from the Ticket Seller or from Nxt Museum and is advised to offer the unscanned Ticket for resale through that platform.

4.13 A Visitor who has been granted access and whose Ticket has been scanned is not entitled to any refund of the Ticket price or other compensation if the Visitor is subsequently removed from the Venue in accordance with Article 7.

5. House Rules

5.1 Nxt Museum welcomes everyone who visits the Venue with an open-minded and respectful attitude towards each other, the artists, the programme, the artworks, the Venue and Venue Staff. Visitors must behave in accordance with public order, public decency and these House Rules, and immediately follow all instructions of Venue Staff, the police, the fire brigade and other competent authorities.

5.2 Nxt Museum operates a zero tolerance policy on drugs. The possession, use, offering, sale or distribution of drugs, including soft drugs and nitrous oxide (laughing gas), at the Venue is prohibited. Drugs found will be confiscated. Nxt Museum may hand over the Visitor and any confiscated items to the police. Dealing in drugs will always be reported to the police.

5.3 Nxt Museum operates a zero tolerance policy on discrimination, hate, violence and harassment. This includes racism, colourism, xenophobia, antisemitism, Islamophobia, sexism, homophobia, transphobia, ageism, ableism and any other form of hate, as well as sexual, verbal, emotional or physical harassment, intimidation, unwanted touching, stalking and spiking of drinks. Any such behaviour will lead to immediate removal from the Venue and may lead to exclusion under Article 7.3. Visitors who experience or witness such behaviour are encouraged to report it immediately to Venue Staff or, where present, to the awareness team.

5.4 It is prohibited at the Venue to:

(a) use violence or threaten violence, or engage in fighting, crowd surfing, stage diving or other behaviour that endangers others;

(b) touch, climb on, move or interfere with artworks, installations, projection surfaces, technical equipment, stages, fences, barriers or structures, unless expressly permitted;

(c) block, obstruct or remain unnecessarily near emergency exits, escape routes, fire-fighting equipment or other safety provisions;

(d) enter backstage, technical, staff or other restricted areas without authorisation;

(e) throw objects or liquids;

(f) offer, sell or distribute goods, flyers, stickers, samples or promotional material, or carry out any form of advertising or promotion, at the Venue or in its immediate surroundings before, during or after an Event, without the prior written consent of Nxt Museum;

(g) damage, soil or deface the Venue or its contents;

(h) take drinks or glassware out of the designated areas or out of the Venue;

(i) cause a nuisance to other Visitors, Venue Staff or local residents; or

(j) act in breach of any law, permit condition or instruction of Venue Staff.

5.5 Visitors may not bring into the Venue or have in their possession:

(a) drugs, including soft drugs, and nitrous oxide, including cartridges and balloons;

(b) firearms, other weapons or items that may be used as weapons, including knives, pepper spray and imitation weapons;

(c) fireworks, flares, smoke bombs, lighters in large quantities or other flammable or explosive items;

(d) glass, cans, plastic bottles and other containers, and food and beverages brought from outside;

(e) laser pointers, drones and professional photo, film or audio recording equipment;

(f) suitcases, umbrellas, and bags or backpacks exceeding 29 x 40 x 22 cm or any other size communicated for the Event;

(g) animals, with the exception of assistance dogs admitted in accordance with Article 8.6; and

(h) any other item that Venue Staff reasonably consider to be dangerous or disruptive.

Prescription medicines are permitted in a quantity for personal use during the Event, in their original packaging and accompanied by a prescription or medical statement in the Visitor’s name. The Visitor must declare them at the security check on entry. Venue Staff may refuse medicines where there is doubt about their nature or quantity.

5.6 Prohibited items may be refused or confiscated. Confiscated items will not be returned, except where Nxt Museum decides otherwise, and may be handed over to the police. Nxt Museum is not obliged to store any item that is refused at the entrance.

5.7 Smoking, including the use of electronic cigarettes, vapes and heated tobacco products, is permitted only in the designated outdoor smoking areas.

5.8 Alcoholic beverages are served only to persons aged 18 and over and are not served to persons who are visibly intoxicated. Passing alcoholic beverages to persons under 18 or to persons who are visibly intoxicated is prohibited.

5.9 The Venue is located in an area with nearby residents and businesses. Visitors must be mindful of the neighbours, arrive and leave quietly, use the designated bicycle parking facilities and follow the instructions of traffic controllers. Bicycles and other vehicles parked outside the designated areas may be removed.

5.10 Nxt Museum or the Promoter may apply additional rules for a specific Event, such as a phone-free policy on the dancefloor or throughout the Venue. Such rules apply as communicated to the Visitor in advance or at the Venue, provided they do not conflict with these Visitor Terms. A Visitor who does not comply with a phone-free policy after a warning may be removed from the Venue in accordance with Article 7.1. A phone-free policy does not apply to Venue Staff, nor to the use of a phone in an emergency.

6. Safety, crowd management and emergency measures

6.1 Nxt Museum, together with its Production Partner, exercises operational control over every Event at the Venue, including the door policy, crowd management, security, capacity and the layout of the Venue. Instructions of Venue Staff relating to safety, routing and crowd management are binding on all Visitors.

6.2 Nxt Museum may at any time, without prior notice and at its sole discretion, take any measure it considers necessary for the safety of persons, the protection of the Venue or compliance with permits and applicable law, including:

(a) reducing or stopping the sound, lighting or visual effects;

(b) closing or evacuating one or more areas;

(c) interrupting, suspending or shortening the Event; and

(d) terminating the Event and evacuating the Venue.

6.3 In the event of an evacuation, Visitors must leave the Venue immediately by the nearest emergency exit or as directed by Venue Staff. Re-entry after an evacuation is at the discretion of Nxt Museum.

6.4 Events at the Venue may involve high sound levels, strobe and flashing lights, immersive projections, haze and smoke effects and high crowd density. These effects may affect Visitors who are sensitive to light, sound or stimuli, including persons with photosensitive epilepsy. Visitors are strongly advised to wear hearing protection and to take regular breaks in quieter areas. Where a low-stimulus area is available, Venue Staff can direct Visitors to it.

6.5 The use of alcohol or other drugs is never without risk, including risks to health arising from overheating, dehydration, the combination of substances and the effects of substances on judgement and behaviour. Nxt Museum supports the Celebrate Safe campaign and encourages Visitors to know their limits, take regular breaks, drink enough water, look after each other and seek help in good time. Free drinking water is available at the Venue. More information is available at www.celebratesafe.nl.

6.6 First aid is available during every Event. Any Visitor who feels unwell, or who sees another person in need of help, should immediately inform Venue Staff. First aid staff are there to help and Visitors are encouraged to seek help without hesitation, for themselves or for others. Nxt Museum may call in the emergency services whenever it considers this necessary.

6.7 Nxt Museum cooperates with the police, the fire brigade, the municipality and other competent authorities and may provide them with any information necessary for the maintenance of public order and safety, subject to applicable privacy law.

7. Removal and exclusion

7.1 Nxt Museum may remove from the Venue any Visitor who breaches these Visitor Terms, fails to follow the instructions of Venue Staff or, in the reasonable opinion of Venue Staff, presents a risk to the safety, order or security of the Venue, the Event, other Visitors or Venue Staff. A Visitor who is removed is not entitled to any refund or compensation from Nxt Museum.

7.2 A Visitor who commits or is suspected of committing a criminal offence may be held and handed over to the police in accordance with the law.

7.3 In the event of a serious breach of these Visitor Terms, including any breach of Article 5.2, 5.3 or 5.4(a), Nxt Museum may exclude the Visitor from access to all Events and other activities at the Venue for a period determined by Nxt Museum, irrespective of the Promoter of those Events. Nxt Museum will inform the Visitor of the exclusion and its duration and will record the personal data necessary to enforce it, in accordance with Article 11.

8. Bar, payments and Venue facilities

8.1 The bar and food and beverage service at the Venue are operated by or on behalf of Nxt Museum. Payment at the Venue is cashless only. Any credit, tokens or vouchers purchased for use at the Venue are valid only during the Event for which they were issued. Refunds of unused cashless credit are subject to the terms of the cashless payment provider as communicated at the Venue.

8.2 Where reusable cups or deposit-bearing containers are used, the deposit is refunded only upon return of the cup or container at the designated return points during the Event.

8.3 Lockers are provided, subject to availability, by or on behalf of Nxt Museum through a third-party provider whose terms apply to their use. Visitors are advised not to store valuables in lockers. Items remaining in lockers after the Event may be removed and handled as lost property.

8.4 Lost property found at the Venue must be handed to Venue Staff. Nxt Museum will keep lost property for a period of at least two weeks after the Event, after which it may be disposed of or donated. Identity documents will be handed over to the municipality or the police. Perishable, soiled or hazardous items may be disposed of immediately. E-mail to ade@nxtmuseum.com for lost items.

8.5 Visitors with a disability or specific access requirements are encouraged to contact Nxt Museum via ade@nxtmuseum.com before the Event, so that reasonable arrangements can be made where possible.

8.6 Assistance dogs are admitted provided the Visitor has informed Nxt Museum before the Event and Nxt Museum has confirmed that their presence can be accommodated safely. In reaching that decision, Nxt Museum will take into account the welfare of the animal and the nature of the Event.

9. Photography, filming and recordings

9.1 Visitors may take photographs and short video recordings with a mobile phone for private, non-commercial use only, unless a phone-free policy applies under Article 5.10. It is prohibited to make professional recordings, to livestream, to record complete performances or to use any recording made at the Venue for commercial purposes without the prior written consent of Nxt Museum and the Promoter.

9.2 The artworks, installations, visuals and projections at the Venue are protected by intellectual property rights. Recordings of them may not be published, reproduced or exploited other than for private use.

9.3 Nxt Museum, its Production Partner, the Promoter and accredited press may make photographs, video and audio recordings during Events, in which Visitors may appear. Visitors will be informed of this at the entrance of the Venue. Such recordings may be used for reporting on the Event and for the promotion of Nxt Museum, the Promoter and future Events, in accordance with applicable privacy and portrait rights. A Visitor who does not wish to appear recognisably in such recordings may inform the photographer or camera operator on the spot, or may contact Nxt Museum afterwards, in which case Nxt Museum will make reasonable efforts to refrain from further use of recognisable images of that Visitor.

10. Programme changes, cancellation and postponement

10.1 The Promoter is responsible for the programme of an Event. Nxt Museum does not guarantee the appearance of any artist, the line-up, the running order or the duration of any performance.

10.2 Any change to the programme and any cancellation or postponement of an Event is communicated by the Promoter or the Ticket Seller. It is the Visitor’s responsibility to check the communication channels of the Promoter. Any claim relating to a change, cancellation or postponement must be directed to the Ticket Seller and is governed by the Promoter Terms.

10.3 Where an Event is interrupted, shortened or terminated as a result of a measure taken by Nxt Museum under Article 6.2, or as a result of force majeure under Article 14, the Visitor is not entitled to any refund or compensation from Nxt Museum. Any rights the Visitor may have against the Ticket Seller remain unaffected.

11. Privacy

11.1 Nxt Museum processes personal data of Visitors as controller for the purposes of access control, security, safety, the handling of incidents, first aid and complaints, the enforcement of exclusions and compliance with legal obligations, in accordance with the General Data Protection Regulation and the privacy statement of Nxt Museum published on www.nxtmuseum.com.

11.2 The Promoter and the Ticket Seller process personal data relating to the purchase of Tickets, ticketing and marketing as independent controllers under their own privacy statements. Nxt Museum is not responsible for such processing.

11.3 Camera surveillance is in operation at the Venue for the protection of persons and property. The presence of cameras is indicated by signs. Camera images are retained only for as long as necessary for these purposes, unless they are required for the investigation of an incident, and may be provided to the police and the judicial authorities where there is a legal basis for doing so.

11.4 Identity documents are checked visually. Nxt Museum does not copy or scan identity documents, except where permitted by law.

     11.5 Visitors may exercise their rights under applicable privacy law by contacting Nxt Museum through the contact details published on www.nxtmuseum.com.

12. Liability of Nxt Museum

12.1 Travelling to and from the Venue and entering, attending and leaving an Event is at the Visitor’s own risk, subject to the provisions of this Article.

12.2 Nxt Museum is not liable for any damage arising from:

(a) any act or omission of the Promoter, the Ticket Seller, artists or any party engaged by them;

(b) the content, quality or duration of the programme, or any change, cancellation or postponement of an Event by the Promoter;

(c) the loss, theft of or damage to clothing, belongings or other items of the Visitor, including items stored in lockers;

(d) the Visitor’s own acts or omissions, including any breach of these Visitor Terms or the use of alcohol, drugs or other substances;

(e) any measure taken in accordance with Article 6.2 or any exclusion or removal in accordance with Article 7; or

(f) hearing damage, where sound levels complied with the applicable standards and permit conditions.

12.3 Nxt Museum is not liable for indirect or consequential loss, including travel and accommodation costs, loss of income and loss of enjoyment.

12.4 Any liability of Nxt Museum is limited to the amount paid out under its liability insurance in the relevant case, increased by the applicable deductible.

12.5 The exclusions and limitations in this Article do not apply to damage caused by intent or deliberate recklessness on the part of Nxt Museum or its executive management, nor to the extent that they cannot be relied upon under mandatory law, including in respect of liability for death or personal injury.

12.6 The Visitor must report any damage to Venue Staff at the Venue immediately after it has occurred, where reasonably possible, and must notify Nxt Museum in writing within 14 days after the Event, stating the nature and cause of the damage. Any claim against Nxt Museum lapses if legal proceedings have not been instituted within one year after the Visitor became aware, or could reasonably have become aware, of the damage.

12.7 The exclusions and limitations of liability in these Visitor Terms are also stipulated for the benefit of the Production Partner and of Venue Staff, who may invoke them directly against the Visitor.

13. Liability of Visitors

13.1 The Visitor is liable for all damage caused by their acts or omissions to Nxt Museum, the Venue, the artworks and installations, equipment, Venue Staff, other Visitors and third parties.

13.2 The Visitor must reimburse Nxt Museum for all costs, fines and penalties imposed on or incurred by Nxt Museum as a result of the Visitor’s breach of these Visitor Terms, including fines for smoking in prohibited areas, the costs of an unnecessary call-out of the emergency services, and cleaning or repair costs, including the costs of removing flyers, stickers or other promotional material distributed in breach of Article 5.4(f).

13.3 The Visitor indemnifies Nxt Museum against all claims of third parties arising from the Visitor’s breach of these Visitor Terms or from the Visitor’s unlawful acts at the Venue.

14. Force majeure

14.1 Nxt Museum is not liable for any failure to perform its obligations, or for any damage suffered by a Visitor, to the extent caused by force majeure. Force majeure includes any circumstance beyond the reasonable control of Nxt Museum, such as government measures, the refusal, restriction or withdrawal of permits, instructions of the competent authorities, fire, flooding, extreme weather conditions, power or utility failures, failures of suppliers, strikes, (threats of) terrorism or public disorder, epidemics and pandemics and the related government measures, and any act or omission of the Promoter or its artists.

14.2 In the event of force majeure, Nxt Museum may restrict access to the Venue, modify its facilities or services, or interrupt, suspend or terminate an Event. Any claim relating to the Ticket must be directed to the Ticket Seller in accordance with Article 10.2.

15. Complaints

15.1 Complaints relating to Tickets, refunds, the programme or the Event information must be submitted to the Promoter or the Ticket Seller through the contact details stated on the Ticket or the event page.

15.2 Complaints relating to the Venue, its facilities, Venue Staff, access or safety may be submitted to Nxt Museum through the contact details published on www.nxtmuseum.com. A complaint should be submitted as soon as possible, and preferably within 14 days after the Event, with a complete and clear description, so that it can be properly investigated. Nxt Museum will aim to respond substantively within 14 days of receipt.

16. Applicable law and competent court

16.1 These Visitor Terms and all agreements and legal relationships between Nxt Museum and the Visitor are governed by Dutch law. This choice of law does not deprive a Visitor acting as a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.

16.2 All disputes between Nxt Museum and a Visitor are submitted exclusively to the competent court in Amsterdam, the Netherlands, without prejudice to the mandatory rules of jurisdiction that apply to consumers.

17. Final provisions

17.1 Nxt Museum may amend these Visitor Terms. The version published on www.nxtmuseum.com on the date of the Event applies. Amendments do not affect any rights acquired by a Visitor before the amendment in relation to a Ticket purchased from Nxt Museum.

17.2 If any provision of these Visitor Terms is void or annulled, the remaining provisions remain in full force. The void or annulled provision will be replaced by a valid provision that approximates its purpose as closely as possible.

17.3 If these Visitor Terms are translated, the English version prevails in the event of any inconsistency.

17.4 These Visitor Terms are available on www.nxtmuseum.com, can be stored and printed, and will be sent free of charge upon request.
